Elder Abuse

Elder Abuse is one of the fastest-growing causes of Estate Litigation. Unfortunately, there is no shortage of people willing to physically, emotionally, or financially harm their elders—and it is critically important to retain legal counsel to effectively protect your loved ones.
When someone is inflicting physical or financial harm on your elderly loved one, or the wrong person has gotten a hold of the financials, things can get out of hand very quickly.
Time is of the essence.

Elder Abuse comes in two different forms from a legal perspective: physical or financial abuse. Sometimes children will inflict bodily injury on their parents or grandparents, force them to live in unfavorable conditions, or take advantage of them financially through theft or fraud. Frequently, we see elders being manipulated into giving money to people whom they thought they could trust, or lines of credit or loans taken out by unscrupulous people on the elder’s behalf.

Temporary Restraining Orders can be filed to get the abuser away from your loved one, and after 21 days, a court appearance can be made to file for permanent restraining orders. Elder abuse is a serious issue, and if the court finds that there was abuse, the district attorney could file criminal charges.
